BAYSEN
(BAYINDIRLIK ISCILERI SENDIKASI)
Independent labour union founded in Ankara on April 18, 1967 to operate in the construction branch; affiliated to the WFTU member International of Workers in Construction and Construction Materials. The union was founded by Sadi Özgün (temporary chairman), Ergun Onat, Ali Karakök, Ergun Yalim, Leyla Yanilmaz and Nurtan Onur. The union held general assembly meetings on: 19.4.1968, 25.10.1969, 17.2.1972, 12.5.1972 (extraordinary), 12.5.1973, 27.8.1974 (extraordinary), 25-26.5.1977, 30-31.8-1.9.1979, in 1991, and on 11-12.4.1992. The board elected at the last congress was composed of M. Ali Polat (chairman), Macit Gününoglu, Mustafa Tari, Yavuz Aslibay and Ismet Cinbis. Baysen was originally an enterprise union, founded by workers at the Construction Department of the Ministry of Public Works. In 1974 it decided to affiliate to DISK and the name of the union was changed so that it could organize construction workers in general. In 1975 when 6 workers at the Ministry of Public Works were dismissed, all union members at this workplace stopped work and organized a 9-day sit-in, erecting tents in the garden of the enterprise. The action ended with the reemployment of the 6 workers. In the same year three foreign companies fired 15 workers from the Iraq-Iskenderun pipeline construction in order to prevent the organization of the union at the workplace. As a consequence, 804 workers started a resistance involving various job actions. The resistance lasted for three months and ended with the signing of a collective labour contract and the reinstatement of dismissed workers. A theatre group in Ankara wrote and staged a very successful play about this action under the name of 804 Workers". Later that year the union succeeded in overcoming the repressions of the employer at the road construction between Elbistan-Kapidere in order to obstruct the organization of the workers after a 15-day action by 300 workers. In 1977 the bulletin issued by the union was closed by the authorities on the grounds that the necessary permissions had not been obtained. The congress in 1977 made significant contributions to the growth of the union, which began to flourish after that date both quantitatively and qualitatively. In March 1978 the independent Konut-Is union decided to join Baysen. In 1979 Baysen was expelled temporarily from DISK, together with Maden-Is, Bank-Sen and Yeralti Maden-Is. Baysen affiliated to the International of Workers in Construction and Construction Materials in 1979 and after this year placed a greater stress on its relations with international trade unions. Baysen defended direct democracy in the union. As a consequence, it formulated the demands in its collective negotiations by means of questionnaires filled by the members, and the draft agreements were afterwards discussed at member meetings before the negotiations with the employers were initiated. Some of the agreements that it signed a short time before the military coup in 1980 were the most advanced collective labour contracts of that time with respect to both economic and democratic gains. The union was closed by the military government in 1980, and some of its leaders were arrested and served long prison terms. Baysen was reopened in 1991. The union was expelled from DISK in January 1996 on the grounds that it did not conduct any activities and had not convened its general assembly within the legal period. The formalities for the liquidation of the union that were started in 1996 are still in progress. The two publications of the union, the biweekly Baysen Özel Sayi" and the weekly Haber Bülteni", have also been discontinued. The union reported 2,337 members in 1974, 2,150 in 1977, 14,540 in 1979 and 6,500 in the 1980s. It reported 17 members in 1996.

However, the labour court rejected a lawsuit on grounds of insufficient evidence. In January 1994 the union leaders were again indicted for not having convened the general assembly meeting within the legal 6-month period. This case is still on trial.
